These Terms and Conditions ("Terms") govern the provision of services by Pace Doctor ("Pace Doctor", "we", "our", or "us") to any individual, organisation or entity ("Client", "Participant", "you" or "your"). By engaging Pace Doctor, purchasing services or products, attending coaching sessions, workshops or presentations, or accessing our website or educational materials, you acknowledge that you have read, understood and agree to these Terms.

Guiding Principle
Pace Doctor is committed to acting professionally, ethically and in the best interests of athletes. Every recommendation is made honestly, independently and in good faith, using the best available evidence, informed professional judgement and a genuine commitment to improving athlete performance, wellbeing and long-term development. While every reasonable effort is made to provide high-quality advice and services, the implementation of recommendations and decisions regarding participation in sport ultimately remain the responsibility of the athlete and those responsible for their care and coaching.

1. Our Purpose
Pace Doctor exists to improve the performance, durability and long-term development of cricket fast bowlers through evidence-informed coaching, biomechanics, education and strategic advice. Our services are intended to support informed decision-making by athletes, coaches, parents, schools, clubs and sporting organisations.

2. Scope of Services
Services provided by Pace Doctor may include, but are not limited to:
• biomechanical assessments
• video analysis
• individual coaching
• online coaching
• performance planning
• workload advice
• injury risk education
• workshops and presentations
• coach education
• consulting services
• research translation
• digital resources and educational content.

3. Evidence-Based Practice
Pace Doctor is committed to providing advice that reflects:
• the best available scientific evidence;
• current understanding of fast bowling biomechanics;
• accepted principles of sports science and athlete development; and
• extensive professional experience in elite and community cricket.
Sports science continues to evolve. Recommendations may change as new evidence emerges. While every reasonable effort is made to ensure information is accurate and current, Pace Doctor does not warrant that any advice, recommendation or educational material is complete, error-free or suitable for every individual or circumstance. Professional judgement will always be exercised using the information available at the time.

4. No Guarantee of Outcomes
Performance improvement depends on numerous factors beyond the control of Pace Doctor, including but not limited to:
• athlete commitment;
• coaching environment;
• training quality;
• physical development;
• medical history;
• genetics;
• recovery practices; and
• implementation of recommendations.
Accordingly, Pace Doctor does not guarantee:
• improved performance;
• increased bowling speed;
• team selection;
• reduced injury risk;
• rehabilitation outcomes; or
• any particular sporting achievement.
Recommendations represent professional opinion rather than guaranteed outcomes.

5. Medical Disclaimer
Pace Doctor provides education, coaching and performance advice.
Pace Doctor does not provide:
• medical diagnosis;
• medical treatment;
• physiotherapy;
• rehabilitation services;
• psychological counselling; or
• any regulated health service unless expressly stated.
Information provided should not replace advice from a suitably qualified medical practitioner or allied health professional. Participants experiencing pain, injury or illness should seek appropriate medical assessment before continuing training or competition.

6. Participant Responsibilities
Participants acknowledge that they are responsible for:
• their own health and wellbeing;
• providing accurate information regarding injuries and medical history;
• implementing recommendations appropriately;
• exercising reasonable judgement during training;
• obtaining medical clearance where appropriate.
Parents, guardians and coaches are responsible for ensuring junior athletes participate appropriately for their age, maturity and physical condition. Where a Participant is under 18 years of age, a parent or legal guardian must consent to the Participant’s involvement in Pace Doctor services and remains responsible for decisions concerning the Participant’s training, competition, medical care and overall wellbeing.

7. Inherent Risks
Cricket fast bowling is a physically demanding activity.
Participation carries inherent risks including:
• muscle strains;
• ligament injuries;
• stress fractures;
• spinal injuries;
• falls;
• impact injuries;
• fatigue;
• illness; and
• in rare circumstances, serious permanent injury.
By participating in services provided by Pace Doctor, you acknowledge these inherent risks and voluntarily accept responsibility for your participation.

8. Limitation of Liability
To the fullest extent permitted by law, Pace Doctor excludes liability for any direct, indirect, incidental, consequential or economic loss arising from:
• participation in coaching;
• implementation of recommendations;
• use of educational resources;
• video analysis;
• online content;
• workshops;
• presentations; or
• consulting advice.
Where liability cannot legally be excluded, Pace Doctor's liability will be limited to the maximum extent permitted under applicable legislation. Nothing in these Terms excludes any rights that cannot be excluded under the Australian Consumer Law.

9. Athlete Decisions
All decisions regarding:
• training;
• competition;
• bowling workloads;
• return to play;
• rehabilitation;
• medical treatment; and
• participation
remain the responsibility of the athlete and, where applicable, their parent, guardian, coach or treating practitioner. Pace Doctor provides recommendations only.

10. Video Analysis and Online Services
Biomechanical assessments are based upon the information supplied. The quality, angle, frame rate and completeness of video footage may influence the observations and recommendations provided. Assessments represent professional opinion based on the available information and should not be interpreted as definitive medical or scientific conclusions. For online services, clients are responsible for ensuring they have a safe training environment, appropriate supervision where required, suitable equipment and reliable technology. Pace Doctor is not responsible for interruptions, delays, loss of data, poor video or audio quality, platform outages, internet failures or other technical issues outside its reasonable control.

11. Intellectual Property
Unless otherwise agreed in writing, all intellectual property remains the property of Pace Doctor.
This includes:
• reports;
• educational resources;
• presentations;
• graphics;
• videos;
• assessment frameworks;
• methodologies;
• online courses;
• templates;
• written advice;
• digital resources.
Materials may not be reproduced, distributed, sold or incorporated into commercial products without prior written permission.

12. Confidentiality
Pace Doctor will take reasonable steps to protect confidential information provided by clients.
Information may be shared where:
• required by law;
• authorised by the client;
• necessary to protect health or safety; or
• reasonably required to deliver agreed services with other nominated professionals.

13. Photography and Video
Pace Doctor may record video or photographs during coaching for performance analysis. Such material remains confidential unless separate written consent is provided for promotional or educational use. Clients may withdraw consent for promotional use at any time.

14. Privacy
Pace Doctor manages personal information in accordance with applicable Australian privacy legislation. Personal information is collected only for legitimate business purposes including:
• service delivery;
• communication;
• coaching;
• billing; and
• legal compliance.
Pace Doctor may collect and hold information such as names, contact details, billing information, coaching history, injury or training information, photographs, video footage and communications relevant to service delivery. Personal information may be stored electronically or in physical records and may be disclosed to service providers, professional advisers or nominated coaches, parents, guardians or organisations where reasonably necessary to deliver services, administer the business, comply with law or protect health and safety. Clients may request access to, or correction of, their personal information by contacting Pace Doctor. Pace Doctor will take reasonable steps to protect personal information from misuse, interference, loss and unauthorised access, modification or disclosure.

15. Payments
Fees, payment methods and due dates will be specified at the time of booking, proposal or invoicing. Unless otherwise agreed in writing, payment is due by the date stated on the invoice or booking confirmation. Late payments may incur interest or collection costs where permitted by law. Pace Doctor may suspend or decline further services where fees remain unpaid. Any refunds, credits or transfers will be handled in accordance with these Terms, the agreed booking conditions and applicable Australian Consumer Law rights.

16. Cancellations and Rescheduling
Cancellation and rescheduling requirements applicable to specific services will be advised at the time of booking. Clients should provide as much notice as reasonably possible if they need to cancel or reschedule. Failure to attend a scheduled appointment, session, workshop or presentation without reasonable notice may result in forfeiture of fees or the requirement to pay reasonable costs already incurred. Where Pace Doctor must cancel or reschedule due to illness, weather, safety concerns, venue issues or other circumstances, Pace Doctor will use reasonable efforts to offer an alternative time, credit or refund where appropriate.

17. Force Majeure
Pace Doctor will not be liable for delays or inability to provide services resulting from circumstances beyond its reasonable control, including natural disasters, government restrictions, illness, internet outages or other unforeseen events.

18. Governing Law
These Terms are governed by the laws of New South Wales, Australia, unless otherwise agreed in writing. Any disputes shall be subject to the jurisdiction of the courts of New South Wales, Australia, unless another jurisdiction is required by law.

19. Severability
If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be read down or severed to the extent necessary, and the remaining provisions will continue in full force and effect.

20. Entire Agreement
These Terms, together with any written proposal, invoice, booking confirmation, consent form or service-specific terms provided by Pace Doctor, constitute the agreement between the parties in relation to the relevant services.

21. Changes to these Terms
Pace Doctor may amend these Terms from time to time. The most current version will be published on the Pace Doctor website and will apply from the date of publication.

22. Acceptance
By engaging Pace Doctor in any capacity, including purchasing services, attending coaching sessions, participating in workshops, submitting videos for analysis, accessing online resources or using the Pace Doctor website, you acknowledge that you have read, understood and agree to these Terms and Conditions.
